Terms of Service

These Terms of Service (the “Terms”) form a legally binding agreement between you and What’s Up Washes LLC (“What’s Up Washes,” “we,” “us,” or “our”) regarding your use of our websites at whatsupwashes.com and coatings.whatsupwashes.com (the “Sites”), our mobile car detailing services, our Gtechniq Certified ceramic coating services, and our recurring detailing membership program known as “The Plan” (collectively, the “Services”).
By booking a service, requesting a quote, signing up for a membership, or otherwise using the Services, you confirm that you have read, understood, and agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least eighteen years of age and legally capable of forming a binding contract to use the Services. By using the Services, you represent that you meet these requirements and that all information you provide is accurate.
2. The Services
We provide mobile car detailing and ceramic coating services in the Greater Richmond, Virginia metropolitan area. Specific service inclusions, duration estimates, and pricing are described on the Sites and may be updated from time to time. Service availability depends on geographic location, scheduling, weather, and operational capacity.
We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time without prior notice, except where prior notice is required by law or by a separate agreement with you.
3. Booking and Scheduling
When you submit a booking, you agree to provide accurate name, contact, vehicle, and service-address information. Submitting a booking is a request — it becomes a confirmed appointment only when we send a confirmation message via email or text.
To deliver the Services we will need:
- Access to the vehicle at the service address during the appointment window;
- A safe, level, and reasonably flat area to work on the vehicle (driveway, parking pad, or street with available shoulder);
- Reasonable proximity to a water source for services that require water, or written prior agreement on a no-water alternative;
- For coating, paint correction, and certain interior services, an area protected from direct sunlight and rain for the duration of the service.
If access conditions are not met when our technician arrives, we may attempt the service to the extent practical, reschedule the appointment, or apply the no-show fee described in Section 5, depending on the circumstances.
4. Pricing, Estimates, and Payment
Prices shown on the Sites are estimates based on the vehicle size category and service selection you provide. The actual price may differ if, upon inspection, the vehicle requires additional time, materials, or specialized work — for example, heavy pet hair, embedded contamination, severe oxidation, or pre-existing damage that materially affects the scope of work. We will discuss any price adjustment with you before performing the additional work.
Payment is due upon completion of the service unless we have agreed otherwise in writing. We accept the payment methods listed on the Sites and processed by our payment provider. By providing a payment instrument, you authorize us (and our payment provider) to charge it for the agreed amount.
Promotional discounts and introductory pricing are subject to eligibility rules disclosed at the time of the offer, may not be combined with other offers unless expressly permitted, and may be withdrawn at any time. We reserve the right to refuse or reverse a discount that we determine was claimed in error, through fraud, or in violation of the offer’s terms.
5. Cancellations, Rescheduling, and No-Shows
We aim to be flexible about life happening. Our policy, applied at our discretion:
- More than twenty-four hours’ notice — cancellation or reschedule is free of charge.
- Less than twenty-four hours’ notice — we may charge a late-cancellation fee of up to twenty-five percent (25%) of the booked service price, at our discretion.
- No-show or refused service on arrival — we may charge a no-show fee of up to fifty percent (50%) of the booked service price, at our discretion, to cover travel and the lost appointment slot.
- Weather — if conditions make it unsafe or impractical to perform the service (rain, freezing temperatures, severe wind, lightning, or extreme heat), we will contact you to reschedule at no additional cost. Weather-driven reschedules initiated by us are never subject to fees.

6. The Plan (Membership)
The Plan is our recurring mobile detailing membership. Signing up requires payment of the first-detail rate at booking, which covers your initial heavier-scope detail (including decontamination and targeted correction work where applicable). Ongoing monthly or biweekly details under The Plan are billed at the membership rate disclosed at signup.
- Founding member rate. If you sign up under our founding-member offer, your monthly rate is locked at the founding price for as long as your membership is continuously active. Lapsed memberships re-enroll at the then-current public rate.
- Pause and cancel. You may pause your membership for up to ninety days in any twelve-month period without losing your rate. You may cancel at any time by replying to any membership-related message, by calling (804) 409-0600, or by emailing bookings@whatsupwashes.com. Cancellation is effective at the end of your current billing period; we do not pro-rate refunds for unused time within a period.
- Add-ons. Members receive twenty-five percent (25%) off à la carte add-on services for the duration of the membership.
- Service area. Membership service is performed within our standard service area. If you move outside the service area, we will work with you in good faith to maintain service where practical or to terminate the membership without penalty.
7. Vehicle Condition and Customer Responsibilities
Before service, please remove personal belongings, valuables, and fragile items from the vehicle. We are not responsible for items left in the vehicle, including items in glove boxes, center consoles, trunks, and similar storage areas.
You agree to disclose any pre-existing damage, mechanical issues (including non-functioning windows, door handles, latches, or alarms), aftermarket modifications, sensitive materials (wraps, custom paint, ceramic coatings applied by others), or recent paint work that has not fully cured. Our technician may decline or modify the scope of service if disclosing this information at the appointment would have changed our willingness to perform the service.
8. Limitations of Service and Pre-Existing Conditions
Detailing is a cosmetic-care service. We do not guarantee removal of every defect, stain, contamination, or imperfection. Some conditions — including deep scratches, rock chips, water spots etched into clear coat, oxidized paint at the substrate level, permanent interior staining, mildew, mold, biohazards, and damage from pre-existing aftermarket coatings — may improve with our work but may not be fully resolved within the standard scope of service.
Ceramic coatings provide hydrophobic and protective properties as described in the manufacturer documentation. They are not a replacement for routine maintenance washing and are not puncture-proof, scratch-proof, or impervious to chemical etching from prolonged contact with strong contaminants (bird droppings, bug residue, tar, road salt). Coating longevity depends on maintenance, climate, and conditions of use.
9. Coating Warranty
Gtechniq Certified coatings include the manufacturer’s durability warranty applicable to the specific product installed (typically three, five, or seven years), subject to the manufacturer’s terms, registration requirements, and maintenance requirements. We will register your coating on your behalf at the time of installation and provide you with the warranty documentation. Honoring the warranty depends on adherence to the maintenance requirements; failure to maintain the coating as directed may void coverage.
10. Disclaimers
THE SERVICES AND THE SITES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY OF INFORMATION ON THE SITES, AND UNINTERRUPTED OR ERROR-FREE OPERATION.
We do not warrant any specific cosmetic outcome on any specific vehicle. Photos on the Sites depict representative work and do not guarantee identical results on every vehicle.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WHAT’S UP WASHES LLC, ITS OWNERS, MEMBERS, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, GOODWILL, OR DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES OR THE SITES, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY.
OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO ANY SERVICE WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID US FOR THE SPECIFIC SERVICE THAT GAVE RISE TO THE CLAIM, OR FIVE HUNDRED DOLLARS ($500), WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, the limitations above apply to the maximum extent permitted by law.
12. Indemnification
You agree to indemnify, defend, and hold harmless What’s Up Washes LLC and its owners, members, employees, contractors, and agents from any claims, demands, losses, liabilities, damages, or expenses (including reasonable attorneys’ fees) arising out of or related to your breach of these Terms, your misuse of the Services, your failure to disclose material vehicle conditions before service, or your violation of any applicable law or the rights of any third party.
13. Intellectual Property
The Sites and their contents — including text, graphics, photos, logos, layouts, and software — are owned by What’s Up Washes LLC or its licensors and are protected by copyright, trademark, and other laws. You may view and use the Sites for personal, non-commercial purposes. You may not copy, reproduce, modify, republish, or distribute any content from the Sites without our prior written consent, except as required by law.
14. Electronic Communications and SMS Consent
By providing your phone number, you consent to receive transactional messages (appointment confirmations, reminders, arrival notices, and similar service communications) by text. Standard message and data rates may apply. Reply HELP for help or STOP to unsubscribe from marketing messages at any time. Unsubscribing from marketing does not stop transactional messages required to fulfill your booking.
By providing your email, you consent to receive transactional and service emails. Marketing emails include an unsubscribe link in the footer.
15. Governing Law and Venue
These Terms are governed by the laws of the Commonwealth of Virginia without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services that the parties cannot resolve informally will be brought exclusively in the state or federal courts located in the City of Richmond, Virginia, and you and we consent to personal jurisdiction and venue there.
16. Dispute Resolution
Before filing a claim, you agree to first contact us at admin@whatsupwashes.com and attempt to resolve the dispute informally for at least thirty days. Most issues can be resolved quickly this way. If we cannot resolve a dispute informally, either party may bring a claim in the courts described in Section 15.
17. Severability and Waiver
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect. Our failure to enforce any right under these Terms is not a waiver of that right.
18. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will revise the “Effective” date above and, where appropriate, provide additional notice. Your continued use of the Services after the new Terms become effective constitutes your acceptance of the revised Terms.
